Deadline24 Contest, 2017 Edition - Terms and Conditions
I General Provisions
§ 1
- The Deadline24 Contest, hereinafter referred to as the Contest, is organized by Future Processing Sp. z o.o. (Llc) with the registered office in Gliwice, ul. Bojkowska 37A, (37A Bojkowska St.), 44-100 Gliwice, recorded in the Register of Entrepreneurs maintained by the District Court in Gliwice, X Commercial Division of the National Court Register under number KRS 0000217147, with share capital of PLN 50,000.00, Tax ID No. (NIP) 634-25-32-128, hereinafter referred to as the Organizer.
- The Contest consists of 2 phases: the qualifying round held on March 12, 2017 and the finals held on April 22-23, 2017.
- Employees and representatives of the Organizer or any other person providing services to the Organizer on any legal basis are not eligible to participate.
- Participation in the Contest is voluntary.
§ 2
The Organizer is the entity awarding the prize within the meaning of Art. 919 and 921 of the Polish Civil Code.
§ 3
- Announcements and information about the Contest shall be posted on www.deadline24.pl site and any questions relating thereto should be forwarded electronically to: [email protected]. The Organizer reserves the right to answer such questions and to communicate with Contest Participants as follows:
- by telephone to the specified phone number,
- via e-mail to the specified e-mail address.
§ 4
The Contest objective is to promote and popularize the knowledge of algorithms, particularly among students of high schools and universities.
II Terms of Participation in the Contest
§ 5
- Participation in the Contest is free of charge.
- All individuals (hereinafter also referred to as the Participants) may participate in the Contest, regardless of age.
§ 6
- In order to participate in the Contest, the Participants shall form teams of three members each.
- To participate in the Contest, the teams complete an application form available on the Contest website. The acceptance of the Terms and Conditions herein by each member of the team in accordance with the method specified by the Organizer is a prerequisite for submitting the team application.
§ 7
- Concerning Participants who are minors: such Participants must obtain and provide the Organizer with the following documents as their participation prerequisites, not later than on the date of registration to the Contest finals:
- A written consent of the Participant's legal representatives to participate in the Contest, to document the course of the Contest in the form of audiovisual and sound recordings and to distribute the Participant's image in the promotional activities carried out by the Organizer and its affiliated entities, along with the acceptance of these Terms and Conditions (the agreement template is attached as Appendix No. 1 to the Terms and Conditions herein).
- A written consent of the Participant's legal representatives to the processing of Participant’s personal data in connection with the Contest (the template of such consent is attached as Appendix No. 1 to the Terms and Conditions herein).
- A written statement of the Participant's legal representatives affirming that no known contraindications exist, including those relating to the Participant's health that could affect his/her ability to participate in the Contest (in particular a chronic illness or the necessity of hospitalization), and that the Participant is capable in terms of health of coping with the hardships related to his/her participation in the Contest (the template of such statement is attached as Appendix No. 1 to the Terms and Conditions herein).
- The above documents must be submitted to the Organizer or at the place of registration for the Contest finals prior to the start of the finals. The timestamp of the documents receipt at the Organizer’s registered office or the place of registration for the Contest finals shall be the determining factor.
- Failure to provide a written consent of any Participant’s legal representatives shall result in the Organizer’s preventing the entire team to compete in the Contest finals.
§ 8
- Concerning Participants who are adults: such Participants must obtain and provide the Organizer with the following documents as their participation prerequisites, not later than on the date of registration to the Contest finals:
- Participant's written consent to participate in the Contest, to document the course of the Contest in the form of audiovisual and sound recordings and to distribute the Participant's image in the promotional activities carried out by the Organizer and its affiliated entities, along with the acceptance of these Terms and Conditions (the agreement template is attached as Appendix No. 2 to the Terms and Conditions herein).
- A written consent to the processing of Participant’s personal data in connection with the Contest (the template of such consent is attached as Appendix No. 2 to the Terms and Conditions herein).
- Participant's written statement affirming that no known contraindications exist, including those relating to the Participant's health that could affect his/her ability to participate in the Contest (in particular a chronic illness or the necessity of hospitalization), and that the Participant is capable in terms of health of coping with the hardships related to his/her participation in the Contest (the template of such statement is attached as Appendix No. 2 to the Terms and Conditions herein).
- The above documents must be submitted to the Organizer or at the place of registration for the Contest finals or prior to the start of the Contest finals. The timestamp of the documents receipt at the Organizer’s registered office or the place of registration for the Contest finals shall be the determining factor.
- Failure to provide a written consent by any Participant shall result in the Organizer’s preventing the entire team to compete in the Contest finals.
§ 9
- The Contest Organizer states that the Contest finals will be held in the venue specified by the Organizer. Information about the venue shall be announced on the Contest website. The Contest finals shall last 24 consecutive clock hours. Therefore, the Organizer submits that each Participant should consider whether any contraindications exist that would prevent or impede his/her participation in the Contest.
- By accepting these Terms and Conditions, a Participant declares that:
- S/he has been informed by the Organizer about the method of conducting the Contest, its duration and the Terms and Conditions and that s/he agrees to these terms.
- S/he accepts all the Terms and Conditions, Rules and Regulations applicable at the venue and furthermore undertakes to comply with safety rules of the venue the Contest finals will be held.
- No known contraindications exist in terms of Participant's health that could affect his/her ability to participate in the Contest (in particular a chronic illness or the necessity of hospitalization).
- S/he is capable in terms of health of coping with the hardships related to his/her participation in the Contest.
- Participant undertakes to secure on his/her own and at his/her own cost access to any medicinal/pharmaceutical products, therapeutic measures and medical agents necessary due to maintain his/her health condition during the Contest.
- Participant shall not pursue any claims against the Organizer related to the deterioration of Participant’s health during the Contest if such condition occurred as a result of failure to inform the Organizer of the existence of the circumstances referred to in item 2, points c or d; of providing false information in relation to such circumstances or [knowingly] misleading the Organizer, as well as in the event of Participant’s negligence to fulfill the obligation referred to in item 3 herein.
- The Organizer reserves the right to exclude the Participant from the Contest due to his/her health condition. The exclusion of one Participant from the Contest may result in the exclusion of the entire team from the Contest.
- The Organizer reserves the right to exclude any Participant from the Contest due to his/her failure to meet the Terms and Conditions, Rules, Regulations or Safety Rules referred to in item 2 herein. The exclusion of one Participant from the Contest may result in the exclusion of the entire team from the Contest.
§ 10
During registration on the day of the Contest finals, the Participants shall show a photo ID to the Organizer. The Identity Document shall mean: personal ID document, passport, driving license or school/university ID.
§ 11
- The Organizer shall not be liable for any costs incurred by the Participants in connection with their participation in the Contest, and in particular shall not provide accommodation for the duration of the Contest or refund the fare.
- The Organizer is not responsible for the Participant’s failure to apply to take part in the Contest or to transfer personal data for reasons beyond the Organizer’s control, in particular in the case of the legal representative's disagreement regarding the Participant’s involvement in the Contest.
- The Organizer shall not be liable for any personal injury and property damage that may occur before, during or after the Contest.
III Contest Terms and Conditions and Progression
§ 12
- The Contest consists of 2 phases: the qualifying round and the finals.
- Detailed information on the progress of the Contest together with the Contest tasks and the criteria for their evaluation shall be announced to the Participants on the following dates in accordance with § 3:
- General evaluation rules and technical arrangements regarding the qualifying round to be announced on www.deadline24.pl not later than on the day before the start of the qualifying round for the finals.
- The content of the preliminary and final tasks as well as detailed evaluation criteria shall be announced to the Participants at the start of each of the two phases of the Contest and made available as the announcement during the Contest.
- It is prohibited to take any action that would or may result in deceiving the Organizer or other Contest Participants, interfering with the proper progress of the Contest, causing security breaches of the Contest server, computers or other equipment belonging to other Participants. Such actions shall result in immediate disqualification of the entire team. The decision to disqualify the team shall be adopted by the Contest Organizer. The decision shall not be subject to appeal.
§ 13
- The qualifying round will take place via the Internet on March 12, 2017 and will proceed for 5 clock hours.
- All teams that have registered for the Contest before the registration deadline, namely March 9, 2017, will participate in the qualifying round.
- The qualifying round will consist of solving the tasks prepared by the Organizer and subsequently forwarding the responses via the Contest process system, the address of which will be made available on the Contest website on March 12, 2017.
- The Organizer shall have the right to extend the duration of the qualifying round period by up to one clock hour when appropriate, specifically in the case of a temporary server failure.
- The Organizer shall not be liable for the failure to provide solutions [to the tasks] using the Contest system in the event of system overload, service failure or other unforeseen circumstances.
- Those participating in the Contest qualifying round may submit comments, complaints and objections to the progression of the qualifying round via e-mail to [email protected] not later than 5 clock hours after the official end of the qualifying round. All submissions shall be considered by the Organizer within 3 business days, and the Participants shall be notified of their legitimacy of the lack thereof via e-mail.
- Evaluation of the solutions submitted by the Participants shall be based on the criteria referred to in § 12, item 2 of the Terms and Conditions herein.
- Elimination results shall be posted on the Contest website at www.deadline24.pl not later than 7 days from the date of completion of the qualifying round; furthermore, they shall be sent to all Participants via e-mail.
§ 14
- A list of teams that qualified for the finals shall be posted on the Contest website on the day of publishing the final qualifying round results. The teams that received the highest number of qualifying points shall be deemed qualified. The number of teams to participate in the Contest finals shall be determined by the Organizer taking into account technical and organizational capabilities, especially the number of available rooms and positions.
- If any of the qualified teams withdraws from the Contest, its place may be assigned to the next ranked team in terms of number of points.
§ 15
- The Contest finals shall last 24 clock hours and the clock shall start on April 22, 2017 at the venue specified by the Organizer. The finals start time shall be designated by the Organizer on the Contest website not later than one the day before the finals.
- If a Participant fails to appear at the place and time indicated in item 1, such Participant shall be disqualified. The Organizer's decision to disqualify shall be made regardless of whether a delay or failure to appear was attributable to reasons under or beyond the control of the Participant. The team of which such Participant is a member may [still] take part in the Contest finals as an incomplete team, based on the decision of other members of the team. Incomplete participation shall not change in any way the team assessment criteria.
- If the finals are held in the location subject to additional laws (subject but not limited to health and safety and fire regulations), the Participants shall agree to familiarize themselves and comply with such regulations.
§ 16
- The final task of the Contest will consist of an appropriate interaction with the Contest server under the terms of and conditions specified in the task.
- Communication with the server during the Contest finals shall be conducted using the TCP/IP protocol.
- During the course of the Contest finals, a web service shall be made available to Participants; the service will provide information and allow for forwarding questions to the Organizer and reporting any problems, errors and inaccuracies. All instructions and explanations shall appear on the above site in real time.
- The Organizer shall provide Participants with the following:
- Premises furnished with chairs and tables.
- Food and beverage service during the Contest finals.
- One 230V power outlet and one LAN RJ-45 jack (or a plug-in cable) for each team.
- However, it is up to the Participants to coordinate and collect on their own all the other equipment needed during the finals, especially computers, switches, network cables, extension cords, office supplies, additional lighting (desk lamps), etc.
- During the Contest finals, the Participants must wear prominently displayed Contest IDs received from the Organizer at the registration for the finals.
- During the Contest finals, the Participants may use any materials and auxiliary devices they brought with them, except the devices providing access to external support.
- The use of any external assistance whatsoever during the Contest finals is prohibited under pain of immediate disqualification; using cell phones and wired or wireless internet access is especially prohibited. Also, any contact/interaction with members of other teams during the Contest finals is expressly prohibited.
- Any Participant’s leaving the location where the Contest finals are held shall be tantamount to his/her withdrawal from further participation in the Contest; however, other team members may continue to participate in the Contest. A diminished team membership shall have no impact on the Contest task assessment criteria.
- The LAN made available to the Participants for the duration of the Contest shall be used only to communicate with other computers used within the team and with the Contest server as specified in the Contest task. Any violation of this rule by any Participant may result in immediate disqualification of the team.
- Persons under the influence of alcohol or drugs or using such measures during the course of the Contest are prohibited from participation in the Contest finals.
- Any disruptive action during the finals, especially listening to loud music and smoking may result in the team being disqualified.
- The Organizer reserves the right to exclude from the Contest any Participants violating the provisions of theTerms and Conditions herein.
- The decision to exclude a team for breach of the prohibitions referred to in this paragraph shall be that of the Organizer. Such decision can be made even after the completion of the finals. There shall be no appeal to such decision, it is immediately enforceable and results in the team being removed from the location where the Contest finals are held.
§ 17
- The Contest winners shall be selected upon the completion of the finals, namely on April 23, 2017; the selection shall consists in choosing, from among all the teams participating in the Contest, the team that received the highest number of points awarded in the finals, based on the criteria referred to in § 12.
- The Contest winners shall be announced on the Contest website within 3 days after the end of the Contest finals.
- The Contest winners shall be selected by Contest Committee which will consist of persons designated by the Organizer.
- Only those solutions and answers to the finals tasks that are provided in accordance with the provisions of the Terms and Conditions herein shall be subject to evaluation. Solutions and answers provided by persons excluded from the participation in the Contest or by persons whose participation in the Contest was not effective due to breach of the provisions of the Terms and Conditions shall not be included in the evaluation.
§ 18
- In-kind prizes shall be awarded in the Contest for taking first, second, and third place. The type and value of the prizes will be announced on the Contest website.
- The Organizer may also grant additional prizes for the teams that will be placed farther in the Contest.
- The Contest prizes shall be appropriately increased by supplementary prize money. The prize money referred to in the preceding sentence is not subject to payment and shall be used to cover the tax in accordance with the provisions of the Act of 26 July, 1991 on income tax from individuals (consolidated text, Journal of Laws of 2016, item 2032). The Organizer shall be responsible for withholding the appropriate tax on the prizes.
- A Contest Prize Winner may not request that his/her prize be exchanged for its cash equivalent or a different prize.
- The Contest Participants may not transfer the rights to receive the prize to a third party.
- In-kind prizes shall be given to the Participants immediately after announcing the results of the Contest finals.
- The Participants acknowledge the receipt of the prize by providing their signature on the prize receipt protocol.
- A decision of the Contest Committee to award a prize shall be final and not subject to appeal.
- The Organizer shall not be responsible for the lack of [Participant’s] ability to collect the prize for reasons attributable to the Contest Winners.
IV Settlements and Rights
§ 19
- The Participants agree for the Contest to be documented in the form of audiovisual and sound recordings. The Participants also agree for their image and the recorded materials, including the interviews they had granted, to be used in the marketing activities associated with the Contest. The Participants shall not be compensated for the use of their image in an audiovisual work.
- The Participants agree to provide entities cooperating with the Organizer with their personal data as well as biographical facts made available during the Contest and for such data to be used by the Organizer and these entities in marketing activities associated with the Contest.
- The Participants applying to participate in the Contest agree to the processing of their personal data by the Organizer and the transfer of such data to third parties for purposes necessary for the implementation of these Terms and Conditions, in accordance with the Act of 29 August, 1997 on the Protection of Personal Data (Journal of Laws of 2016, item 922). Providing personal information is voluntary; however, failure to provide such data shall result in rescinding the option to participate in the Contest.
- The Participants shall have the right to access and correct/edit their personal data.
- The Organizer reserves the right to refuse to issue prizes to the winners unless they provide their personal data necessary to release the prize and to perform other activities applicable under the law.
- The Participants authorize the Organizer and entities cooperating with it to use part or all of the data sent to the Contest server during the progression of and in connection with the Contest, as well as for marketing purposes relating to the Contest.
- The Participants can agree to the processing of their personal data for the purpose of recruitment processes conducted by Future Processing.
- Providing personal data is voluntary.
- The Participants shall have the right to access and correct/edit their personal data.
- The administrator of personal data is the Organizer, i.e. Future Processing Sp. z o.o. (Llc) with the registered office in Gliwice, ul. Bojkowska 37A, (37A Bojkowska St.), 44-100 Gliwice, recorded in the Register of Entrepreneurs maintained by the District Court in Gliwice, X Commercial Division of the National Court Register under number KRS 0000217147, with share capital of PLN 50,000.00, Tax ID No. (NIP) 634-25-32-128.
V Final Provisions
§ 20
- The provisions of the Terms and Conditions herein shall be the sole basis of conducting the Contest, and their construal and interpretation shall be entirely up to the Organizer.
- The Contest Terms and Conditions are available for review on the www.deadline24.pl website.
- The Organizer reserves the right to change the Terms and Conditions of the Contest, including the content of the Terms and Conditions herein, during the Contest. These changes shall take effect upon their being posted on the Contest website and the Contest server in the News format.
- Any complaints regarding the matters covered by these Terms and Conditions shall be forwarded in writing to the Organizer’s address together with a detailed justification not later than 14 days after the completion of the Contest. Failure to do so is tantamount to the expiry of any claims in connection with the Competition submitted by a person. Complaints related to the Contest shall be decided by the Organizer within 14 days from the date of submitting the complaint. The Organizer’s decision with regard to the complaint is irrefutable and not subject to appeal.
- All disputes arising from the enforcement of obligations in connection with this Contest shall be settled by the Court competent to the registered office of the Organizer.
- The method of conducting the Contest is defined exclusively in these Terms and Conditions. All promotional and marketing materials are for informational purposes only.
- The provisions of these Terms and Conditions shall be governed by Polish law. In matters not governed by these Terms and Conditions, provisions of the Civil Code and other laws shall apply.
- The Participants are fully responsible for the accuracy and honesty of data provided in connection with the Contest. The Participants are liable in particular for providing false or outdated contact information that would hinder or prevent the Contest Organizers from contacting the Participant.
- The Organizer shall not be responsible for the consequences of Participant’s providing false data or data relating to another person.
- The Organizer shall not be liable for any delays or failures in communicating with the Contest Participants due to reasons beyond the Organizer’s control.
- The Organizer's liability towards the Participant is limited to the value amount of one prize referred to in § 18 item 1.
